Terms and Conditions of use
1. Purpose
1.1. These General Terms and Conditions of study guides Sale (hereafter referred to as “T&C“) apply to the online sale of all Products (as defined hereafter) of Killexams.com (“Killexams”) to any customer (the “Customer“), either individually or as a group; referred to as “Parties” or “Party” on the killexams.com website (the “Site“).
1.2. All Customer orders imply unconditional acceptance of this Terms & Conditions.
Killexams reserves the right to modify the T&C at any given moment. This applies to all new orders and those which have been previously placed. Killexams requests that the Customer reads the T&C for each order. Customer downloading the products means they are agree with the T&C.
1.3. If Killexams does not exercise its rights at a given time, in relation to one of the clauses within the T&C, this shall not be interpreted as a waiver of its right to invoke these same clauses at a later date.
2. Products
2.1. In the conditions as outlined when an order is placed, Killexams offers its Customers: Certification Exam Questions and Answers; In PDF and Windows based Practice Test Software format.
2.2. The products on sale could only be used for educational and knowledge purposes. The sales and delivery of all Products presented on the Website are available worldwide. Killexams ensures that the customer agrees the T&C before the download permission is granted, but downloading from killexams.com in anyway considered to be fully agree with our terms and conditions.
3. Customer account
3.1 On placing online order, killexams automatically setup account with random username and password and deliver to the customer via email. 3.2 Customer can create own username and password before placing order.
4. Order procedure
4.1. If a Customer wishes to place an order, the Customer must add the desired Products to the Customer basket by clicking on the “Buy Now” button. The Customer can, at any moment, access the Customer cart and make changes by clicking on the corresponding link.
4.2. Once the Customer is ready to confirm the Customer cart, and therefore the order, the Customer must click on the “Payment” button.
The Customer will then follow the order procedure by providing the required invoicing and delivery information.
4.3. The Customer will receive an information summary at the end of the procedure:
Killexams identification;
Ordered Products description;
Ordered Products price (excl. and incl. VAT);
Method of payment;
Delivery email;
4.4. The Customer then confirms the order by clicking on the “Pay Now” button. This final confirmation counts as a signature and express agreement of both the order and these General Terms and Conditions.
5. Proof of order
5.1. The computerised records stored in Killexams’s computer systems will be considered as proof of communications and orders.
5.2. It is expressly agreed that the data stored in Killexams’s computer systems has probative value with regards to Customer orders.
5.3. Once an order has been confirmed, Killexams sends the Customer confirmation by email to the email address provided on the Customer account.
5.4. The customer get the login and download instructions by email.
6. Prices – Payment
6.1. The Product prices as stated on the Product descriptions are indicated in USD. Customer see the local taxes on the screen while ordering.
6.2. The payment is made according to the conditions as stipulated when the order is placed. All payments must be made in full upon ordering.
6.3. Killexams does not have access to the Customer’s bank details and is simply informed that payment has been made by the customer.
6.4. In the absence of payment confirmation, the order is cancelled and the Customer is informed by email.
7. Availability
7.1. Products that appears on the Website are for sale.
7.2. In the event that a Product is unavailable once an order has been placed, Killexams will immediately inform the Customer and will, if needs be, reimburse the Customer as quickly as possible.
8. Right of use
8.1. Killexams holds all intellectual property rights for the Products on sale and the Customer will not infringe said rights.
8.2. Product purchase does not constitute any transfer or restriction of Killexams’s intellectual property rights and/or know-how, whether before or after an order is placed.
8.3. Subject to agreement with the T&C and payment in full by the Customer, Killexams grants the Customer a non-transferable, non-exclusive right of download and use the Software (the object of the order), in binary format, for the duration of purchased account and future moral intellectual property rights as agreed and stipulated by the chinese's local and international conventions. The Customer accepts this right of use.
8.4. The sole purpose of killexam's product is educational. Without express and written authorisation from Killexams, the Customer is not permitted to (i) reproduce, represent, modify, translate or adapt, in any form or format, or use the Software in any manner and/or (ii) reverse engineer the Products (with the exception of legal requirements to the contrary).
8.5. Killexams may integrate third-party guides or part of guides in it's product, the guides purchased by its contracted parties, the purpose of which is making the product more robust.
9. Deliveries – Risk transfer
9.1. Killexams try to deliver the login information to download the products in couple of minutes by email, but it may take up to several hours in worst case. There are several reasons that effect the delivery time like, server response, account setup time, email delivery time etc.
9.3. Any Customer complaint regarding issue in a delivered Product with the order must be sent to Killexams within five (5) days after the Customer has received the Product. After this time, the Customer is deemed to have irrevocably and unconditionally accepted the product.
10. Liabilities
10.1 Killexams.com try to provide 100% correct and reliable educational products but it does not own any responsibility and liabilities whatsoever. Customer has to use killexams study guides, questions/answers and exam simulator on their own risk.
10.2 All the material is checked through proof reading softwares and software converters. Though killexams ensures but still study guides could contain typos, wrong answers of questions and other mistakes that killexams will not be responsible for.
10.3 Killexams sells its software products on "as it is" basis.
10.4 Killexams products may not helpful in case of some customers for improvement of knowledge, making ready for the exam or even passing the exam.
10.5 Killexams ensures that its products are virus free and do not harm computers. But, Killexams is not responsible for any damage to the software, hardware or any other loss by downloding, installing and running the product in anyway, define or not defined here.
10.6 Killexams does not hold responsibility of loss of opportunities, waste of time, waste of money, emotional or health damages caused by failing the exam. Although, Killexams try its best to make the product best to help the most of customers.
11. Refunds and Guarantees
11.1. Killexams try its best to make the product usable and benefitial for the Customer. But in any case if the product is not usable, or useful for the Customer, refund claim could be submitted within 5 days from original order.
11.2. In the event, if Customer fails in the exam after reading and practicing questions and answers product, a refund request could be submitted within 5 days of failing the exam.
11.3 Customer has to send Verifiable exam failing scoresheet with order ID and Username from the registered email address to info@killexams.com and wait for the acknowledgement of refund request.
11.4. Killexams has reserve the right to refuse the refund request if documentation provided is not as required or any other genuine reason whatsoever.
11.5. Killexams PDF guides could be used on any operating system. Killexams Exam Simulator is windows based application that best works on Windows OS. If Customer uses other operating system for exam simulator, killexams takes no responsibility to provide technical support on other operating system.
11.6. On approval, Killexams is liable to refund the amount that it received from the customer for selling the product. Customer could not claim exam fee, travel charges, exam voucher or any fee related to the examination. Killexams owns no liability if Customer has to bears the cost to change operating system, hardware, software or any related problems.
11.7. Customer can not submit refund request without genuine reason, after activation of account, until (in such case) exam failing scoresheet is not submitted. Killexams maintain complete login and download record as displayed on customer MyAccount screen also.
11.8. Killexams try its best to keep the contents up-to-date with the course and syllabus, but does not hold any responsibility of any damage (whatsoever) due to delay in update or change of entire contents by the vendor.
11.9. Any cost, not mentioned here, other than the product price could not be claimerd by the Customer from killexams.
12. Responsibility
12.1. Killexams will not be held liable for any damage done by late delivery of the questions/answers and practice software or other related products.
12.2. Killexams will not be held liable for any indirect and/or non-material damage (such as operational loss, customer loss, missed opportunities and data loss, etc.). This is expressly accepted by the Customer.
12.3. It is recalled that the Customer is solely and fully responsible for the use of Products downloaded from killexams.com website or through any medium like email or direct cloud links. Any damage to the customer's computer software, hardware, environment including emotional, mental, health issues, waste of time or whatever not mentioned here are not liabilities of killexams.
13. Personal data processing
13.1. Killexams do not store any financial information of the customers. It needs First Name, Laste Name, Email Address and Phone number to create account and communicate with the customer in case of any support is needed.
13.2. Killexams do not share email addresses to any 3rd party but killexams.com itself can send emails for promotions to the customers.
14. Termination of service
14.1. Killexams holds the right to terminate/block any account due to misconduct, un-ethical conversation over emails or livechat, violation of terms and conditions and others reasons not mentioned here.
